1. Acceptance of Terms

By accessing or using thediversioncenter.com (the “Site”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.

2. Use of the Site

You agree to use the Site only for lawful purposes. You will not:

  • Attempt to gain unauthorized access to any portion of the Site or related systems.
  • Use automated tools (scrapers, bots) to extract data from the Site beyond what robots.txt permits.
  • Submit false, inaccurate, or misleading information through any form on the Site.
  • Use the Site in any way that violates applicable federal, state, or local law.

3. Pricing, Scheduling, and Inquiries

Prices, availability, and program details shown on the Site are provided for general information and may change without notice. Your fee and appointment details are confirmed when you schedule a service with us.

Submitting an online inquiry, message, or contact form does not schedule an appointment, enroll you in a class, or create a contract. An appointment or enrollment is in place only once we confirm it with you directly.

4. Intellectual Property

All content on the Site, including text, graphics, photos, illustrations, curricula descriptions, design, and code, is the property of The Diversion Center or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and print pages for personal, non-commercial use only. Reproduction, distribution, or modification of any content for commercial purposes without our written permission is prohibited.

5. Third-Party Links and Tools

The Site may include links to third-party websites or embed third-party services (for example, Google Analytics, Google Tag Manager, Microsoft Clarity, GoHighLevel chat and forms, Calendly scheduling, CallRail call tracking, Cloudflare Turnstile, and YouTube). We are not responsible for the content, privacy practices, or accuracy of third-party sites. Your use of any third-party site is at your own risk and subject to that site’s terms.

6. Disclaimers and Limitation of Liability

Information on the Site is general information about our services. It is not legal advice and not medical or clinical advice, and it does not create a counselor–client relationship. For guidance on your specific court, probation, or employment requirements, consult your attorney, probation officer, or the agency that issued the requirement.

The Site and its content are provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. To the fullest extent allowed by Georgia law, The Diversion Center disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Diversion Center is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including (but not limited to) lost profits, lost data, or business interruption. Our total aggregate liability for claims related to your use of the Site is limited to one hundred U.S. dollars ($100).

7. Service-Specific Terms

These Terms of Service govern your use of the website only. Evaluations, classes, counseling, and training are provided under the separate intake, consent, and enrollment terms you agree to when you receive those services. Nothing on this Site modifies, replaces, or supplements those separate agreements.

Whether a particular evaluation, class, or certificate satisfies a court order, probation condition, employer, or agency requirement is decided solely by that court, office, or agency. We cannot guarantee acceptance, and you are responsible for confirming what your requirement calls for.

8. Communications and Consent

When you contact us through the Site, we may call or email you about your inquiry. We send text messages only if you check the SMS consent box on our forms; consent to texts is not a condition of contacting us or receiving services. Message frequency varies, and message and data rates may apply. You can opt out of texts at any time by replying STOP, or reply HELP for assistance. You can also call us at (404) 503-8069.

9. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Cobb County, Georgia, and you consent to the personal jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
